SkinSync Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the SkinSync mobile application and related services (the "Services"). By creating an account or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. About SkinSync and the Services
SkinSync provides product discovery, personalized skincare recommendations, camera-based scanning, skincare routines sharing, and a community forum. External shopping links may be provided to third-party retailers. We do not sell products within the app and are not responsible for third-party transactions.
2. Eligibility
You must be of the legal age of majority under applicable law (or have valid parental/guardian consent where permitted) to use the Services. You represent that the information you provide is accurate and up to date.
3. Account Registration and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree not to:
- Use the Services for unlawful, fraudulent, or harmful purposes.
- Upload content that is illegal, infringing, deceptive, defamatory, obscene, or harmful.
- Harass, threaten, or harm others or encourage such conduct.
- Interfere with, disrupt, or attempt to gain unauthorized access to the Services or other users' accounts.
- Reverse engineer, decompile, scrape, or misuse the Services.
- Bypass access or usage limits and security measures.
5. User-Generated Content (UGC)
- Ownership: You retain ownership of content you submit (e.g., routines, posts, comments, photos, ratings).
- License to SkinSync: You grant SkinSync a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, adapt, publish, translate, create derivative works, distribute, publicly perform, and display your content in connection with the Services and our business, including for promotion and improvement.
- Responsibility: You are responsible for content you submit and must ensure you have necessary rights (including permissions for any persons appearing in photos). Do not upload sensitive personal data of others without consent.
- Moderation: We may remove or restrict content that violates these Terms, applicable law, or community guidelines, or that we reasonably deem harmful.
6. Community Guidelines
Be respectful, provide accurate information, and avoid spam or misleading claims. Do not provide medical diagnoses, prescriptions, or claims of cure. Report problematic content using in-app tools.
7. Medical and Content Disclaimer
The information provided has been compiled from publicly available sources. We disclaim any liability for adverse effects that may result from the use of this information. For personalized advice or if you have specific skin concerns, please consult a qualified dermatologist. SkinSync does not provide medical advice, diagnosis, or treatment. Content and recommendations are informational only.
8. Scanning Feature and Accuracy
Image scanning and ingredient extraction rely on image quality, packaging variations, and third-party data. We do not guarantee that scanned results or analyses are complete, accurate, or error-free. Always verify details with official sources and professionals.
9. External Links and Third-Party Services
The Services may contain links to third-party websites or retailers. We are not responsible for their content, products, services, or policies. Your dealings with third parties are solely between you and the third party.
10. Intellectual Property
SkinSync and its licensors own the Services and all related intellectual property. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes. Do not copy, modify, distribute, publicly display, or create derivative works except as permitted by law or with our written consent.
11. Feedback
If you submit feedback, ideas, or suggestions, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them without restriction or compensation.
12. Changes to the Services
We may change, suspend, or discontinue any part of the Services at any time without liability. We may also impose limits on certain features or restrict access without notice.
13. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKINSYNC AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID (IF ANY) IN THE 12 MONTHS PRIOR TO THE CLAIM OR (B) THB 3,000.
15. Indemnification
You agree to indemnify and hold harmless SkinSync and its affiliates, directors, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law.
16. Termination
We may suspend or terminate your access to the Services at any time if you violate these Terms or if we believe your use poses risk. You may stop using the Services at any time. Upon termination, Sections 5, 7, 9–11, and 13–20 survive.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of Thailand, without regard to conflict of laws. You agree to the exclusive jurisdiction of the courts of Thailand for any dispute arising from or relating to these Terms or the Services.
18. Changes to These Terms
We may modify these Terms from time to time. We will notify you of material changes via in-app notice or other appropriate means. Your continued use after the effective date constitutes acceptance of the revised Terms.
19. Miscellaneous
- Entire Agreement: These Terms constitute the entire agreement between you and SkinSync regarding the Services.
- Severability: If any provision is invalid, the remainder remains in effect.
- Assignment: You may not assign these Terms without our consent. We may assign them without restriction.
- Waiver: Failure to enforce a provision is not a waiver.
